EU court confirms Qualcomm’s antitrust fine, with minor reduction

Europe’s second-highest court upheld a European Commission antitrust fine against U.S. chipmaker Qualcomm for predatory pricing, though it reduced the fine to 238.7 million euros ($265.5 million) from 242 million euros.

The fine stems from Qualcomm’s 2009-2011 practice of selling chipsets below cost to stifle competition from British firm Icera, now part of Nvidia.

Qualcomm’s appeal argued that the affected chipsets represented only 0.7% of the market, insufficient to harm competition.

The court dismissed most of Qualcomm’s claims but agreed partially on the fine calculation, leading to the slight reduction.

Qualcomm can still appeal the decision to the EU Court of Justice.

The ruling follows Qualcomm’s 2022 victory when the court annulled a 997 million euro fine related to its exclusive supply deals with Apple.
