Kenya Court Rejects Petition Regarding VAT on Fuel products.

Sen. Okiya Omtatah of Busia filed a case 2018 opposing the introduction of a tax on petroleum products; but the High Court has dismissed it. Mr. Omtatah claimed that the 16 percent VAT levy was unlawful and amounted to double taxation.

In 2018, former President Uhuru Kenyatta intervened and lowered the VAT to 8%. The case was dismissed by Justice Hedwig. The judge declared, “The petition dated September 5, 2018, is deemed to have no basis and is hereby dismissed.

Mr. Omtatah had asserted that the tax was implemented in spite of a clear Parliamentary vote to halt its implementation.

Petroleum items, according to the newly elected legislator, were considered exempt supply for a period of three years.
